D. LAND POLICY
(Decree No. 46/2014/ND-CP dated May 15, 2014 of the Government regulating the collection of land rent and water surface rent. Article 19: Exemption from land rental and water surface rental.
  1. Exemption from land rent and water surface rent for the entire lease term in the following cases:
a) Investment projects in fields with special investment incentives are invested in extremely difficult socio-economic areas.
b) Investment projects to build housing for workers in industrial parks where the State leases land or subleases land from investors constructing and trading industrial park infrastructure to implement according to approved planning. Approval by competent state agency; Investors are not allowed to include land rental costs in the house rental price.
c) Projects using land to build student dormitories with money from the state budget, the unit assigned to manage and use it for students to live in is not allowed to include the cost of land rent in the house rental price.
d) Agricultural production land for ethnic minorities; land for implementing projects on planting protective forests and sea reclamation forests.
d) Land for construction of public works of public service organizations; Land for construction of scientific research facilities of science and technology enterprises if it meets relevant conditions (if any) including: Land for construction of laboratories, land for construction of technology incubators and Science and technology business incubation, land to build experimental facilities, land to build experimental production facilities.
e) Land for construction of facilities and works providing aviation services, except land for construction of facilities and works serving aviation service business.
g) Agricultural cooperatives use land as premises to build cooperative headquarters, drying yards, and warehouses; Build service establishments directly serving agricultural production, forestry, aquaculture, and salt making.
h) Land to build maintenance and repair stations and parking lots (including ticket sales areas, management and administration areas, and public service areas) to serve public passenger transport activities according to regulations of the law on road transport.
i) Land for construction of water supply works includes: Water exploitation and treatment works, pipelines and works on the water supply pipeline network and works supporting the management and operation of the water supply system (houses). administration, managers, operations, factories, warehouses of materials and equipment).
k) Land for construction of infrastructure for common use in industrial parks and industrial clusters according to planning approved by competent authorities as prescribed in Clause 2, Article 149 of the Land Law.
2. Exemption from land rent and water surface rent during the period of basic construction according to the project approved by the competent authority but for a maximum of 03 years from the date of decision to lease land or water surface. In case the land tenant uses land for agricultural production purposes (growing perennial crops) according to a project approved by a competent authority, the basic construction period of the garden is exempted from land rent applicable to each individual. b) Seven (7) years for investment projects in areas with difficult socio-economic conditions.
c) Eleven (11) years for investment projects in areas with extremely difficult socio-economic conditions; Investment projects in the List of fields with special investment incentives; Projects on the List of investment incentive fields are invested in areas with difficult socio-economic conditions.
d) Fifteen (15) years for projects on the List of investment incentive fields invested in areas with extremely difficult socio-economic conditions; Projects on the List of fields with special investment incentives are invested in areas with difficult socio-economic conditions.
List of fields with investment incentives, fields with special investment incentives, areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions are implemented according to regulations of investment law.
The list of areas eligible for land rent incentives only applies to areas with specific administrative boundaries.
d) Land rent exemption for investment projects on construction and business of infrastructure of industrial parks, industrial clusters, and economic zones is implemented according to the provisions of Clause 10 of this Article.
4. Exemption from land rent in economic zones shall comply with regulations of the Government or Prime Minister on investment incentives for economic zones.
5. Projects to build offices of diplomatic representative agencies, foreign consulates and representative agencies of international organizations in Vietnam according to international treaties to which Vietnam is a member, The exemption of land rent implements the committed treaty or the principle of reciprocity.
6. Projects that are allocated land by the State with land use fees collected before July 1, 2014 and are enjoying land use fee exemption incentives when converting to land lease form will continue to be exempted from paying land rent for  remaining land use period.
7. Land rent exemption for projects using land to build public works with business purposes (socialization) in the fields of education, vocational training, health, culture, sports, and environment. Follow the Government's regulations on policies to encourage socialization of activities in the fields of education, vocational training, health, culture, sports and environment.
8. Land rent exemption for investment projects in agriculture and rural areas shall comply with the Government's regulations on investment incentives in agriculture and rural areas and land rent exemption during the construction period. copies as prescribed in Clause 2 of this Article.
9. Exemption from land rent until the end of 2020 for agricultural land areas within the limit prescribed by law for each region for farmer households, farm members, and members of agricultural cooperatives receiving contracts. of agricultural production enterprises and cooperatives must now switch to renting land and sign land lease contracts with competent state agencies according to the provisions of the Land Law.
10. Investors who are leased land by the State to invest in construction and business of infrastructure of industrial parks, industrial clusters, and economic zones are exempt from land rent after the land rent exemption period of the current period. Basic construction period specified in Clause 2 of this Article, specifically as follows:
a) 11 years if investing in a district-level area that is not on the List of investment incentive areas according to the provisions of investment law.
b) 15 years if investing in a district-level area on the List of areas with difficult socio-economic conditions according to the provisions of law on investment.
c) The entire land lease period if investing in a district-level area on the List of areas with extremely difficult socio-economic conditions according to the provisions of law on investment.
11. The Prime Minister shall consider and decide to exempt land rent for other cases submitted by the Minister of Finance based on proposals of Ministers, Heads of ministerial-level agencies, and agencies under the Government, Chairman of the Provincial People's Committee".
Article 20: Reduce land rent and water surface rent.
  1. Reduce land rent and water surface rent in the following cases:
a) Cooperatives that rent land for use as production and business premises are entitled to a 50% reduction in land rent.

4. Projects to build offices of diplomatic representative agencies, foreign consulates and representative agencies of international organizations in Vietnam according to international treaties to which Vietnam is a member, The reduction of land rent implements the committed treaty or the principle of reciprocity.
5. The Prime Minister shall consider and decide to reduce land rent for other cases submitted by the Minister of Finance based on proposals of Ministers, Heads of ministerial-level agencies, and agencies under the Government, Chairman of the People's Committees of provinces and centrally run cities.
